- Is Germany facing a new equalization of burdens and expropriation of assets in 2024?
The amendment to the Equalization of Burdens Act of 1952 was passed on 12 December 2019. The amendment was made in Article 21 of the Act on the Regulation of Social Compensation Law (SozERG), to which the Equalization of Burdens Act refers linguistically. The word "war victims' welfare" has been replaced by "social compensation". The amendment comes into force on 01.01.2024.
- What it could means “Social Compensation” ?
A new equalization of burdens for the victims of the corona policy?
Chapter 2, Section 2, Subsection 4 of SGB XIV specifically states that the compensation regulation applies in the case of any vaccination that was "publicly recommended by a competent state authority ... publicly recommended and carried out in its area" or "was ordered on the basis of a statutory instrument pursuant to Section 20 (6) or (7) of the Infection Protection Act or was otherwise prescribed by law". According to the current version of the Act on the Prevention and Control of Infectious Diseases in Humans (Infection Protection Act), this also includes "vaccinations against the SARS-CoV-2 coronavirus". Should these have harmful effects "that go beyond the usual extent of a reaction to a vaccination ... ", then state compensation would be due. The legislator's linking of the new SGB XIV with the reformulated Equalization of Burdens Act (Lastenausgleichsgesetz) offers the fundamental possibility of also using assets of the non-injured population for this compensation.
